The wife and in-laws of Bengaluru techie Atul Subhash involved in abetment of suicide case are awarded bail by a Bengaluru court today. Atul Subhash alleged his wife and her family members of harassment and was found dead with suicide from a house in Nagpur on December 9.
Bengaluru techie Atul Subhash Case
His wife Nikita Singhania along with her mother Nisha Singhania and brother Anurag Singhania had filed a bail petition before the session court, Bengaluru in the case.
In earlier appeal it had moved the Karnataka High Court seeking a direction to the session court to dispose of Bail Petition. The session court was ordered by the High Court to make a decision on the petition today.
On Dec 14, Nikita Singhania was arrested in Gurugram while her mother was nabbed from Uttar Pradesh’s Prayagraj along with her brother Anurag.
The 34-year old had recorded a video message and written a 24-page note that described the marital problems, attempt to harass and eventually extort money from him by his estranged wife and her relatives as well as a judge from Uttar Pradesh. He accused his wife and her relatives of pushing him to take the rope through “false” cases and “constant harassment.” He had also flogged his wife of demanding Rs 3 crore to do away with the case.
Subhash married Singhania in 2019. They had a son in 2020.
The parents of the techie have brought forth an application for getting the custody of their four-year-old grandson and have stated that they are not aware of his whereabouts.
‘My son was broken from inside” I believe that every parent wants the best for their children, yet Ehrenreich mother, only wanted her son to become a robot like the rest of society.
Although he was tortured by his wife and her kin and begs one to understand that he never reported it. In the suicide note, he also recommended that his parents should be given custody of the child which was very painful for the family,” said Pawan Kumar—who is the father of Subhash.
“We are expecting much on this aspect when the matter comes up before the Supreme Court on January 7”, he said.
He also said that Ms Singhania used child abuse and treated her son as an ‘ATM’. “My grandson was ATM to her. She had money on the guise of taking care of him. She went to the High Court seeking Rs 20000 to Rs 40000. She went on to appeal for Rs 80,000 . This being the case, she continued to push her husband for more money still. Therefore, we have gone to the Supreme Court for the custody of the child since he is safe with us, he added.
Nikita Singhania’s Bail
Earlier, the counsel for Atul Subhash had said that the accused wife should not be allowed to use the child to press for an anticipatory bail.
The stand we have taken was that the crime which they have committed is very heinous, secondary to this we have filed a habeas corpus petition before the Supreme Court whereby the Court has passed directions to the three states UP, Karnataka and Haryana for ascertaining the whereabouts of the kid and once the child is found then the court will give directions for considering the custody of the kid, said Avinash’s counsel Akash Jindal.
Speaking to this media, the advocate of Atul Subhash, Vinay Singh, stated in their defense that they were arguing on facts on harassment.
“The bail has been allowed. Getting back to the order sheet, I think we’d better wait for it. Our argument was on information, on harassment. The suicide note given was sent to forensics but the possibility was not taken into consideration.
His suicide video has also been handed over to the forensic. His handwriting is also being examined… With the entire family we are. That is why we are struggling to see that justice is done for the family. We will contest it (bail order) … “After seeing the order sheet, and going through it, we can approach the High Court of Karnataka,” Singh told the news agency.
Media had reported that Nikita Singhania and her family approached the Karnataka High Court seeking appropriate directions to the session court to settle the bail Petition.
Subhash and Nikita Singhania decided to tie the knot in 2019 and in the following year, the couple blessed with a son. More to the point, the parents of the deceased techie had also demanded custody of his son. In his suicide note, Subhash accused his wife for treating him like an “ATM”.
